Charter of the City of Stillwater

ORDINANCE NO. 2811

 

“AN ORDINANCE PROPOSING AMENDMENT TO SECTION 3-6 OF ARTICLE III OF THE CHARTER OF THE CITY OF STILLWATER, OKLAHOMA; PROVIDING FOR SUBMISSION THEREOF TO THE QUALIFIED VOTERS OF SAID CITY AT THE NEXT CITY GENERAL ELECTION."

 

 

BE IT ORDAINED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF STILLWATER, OKLAHOMA THAT:

 

Section 1:

 

            That the following amendment to the Charter of the City of Stillwater, Oklahoma, is hereby proposed by the Board of Commissioners of said City and shall be submitted to the qualified voters of said City at the next City General Election, to-wit:  April 6, 2004, in accordance with the Stillwater City Charter and applicable state laws.  It is the purpose and intention of this Commission to enact this Ordinance for the purpose of calling and holding said election in order that said proposed amendment shall be submitted to the qualified voters of the City of Stillwater on that date and same shall be effective if they are approved by a majority of the votes cast thereon by the qualified voters of the City of Stillwater voting at said election.

 

Section 2:

 

            That the proposed amendment to the Charter of the City of Stillwater, Oklahoma, shall read as follows, to-wit:

 

            PROPOSED CHARTER AMENDMENT

 

(1)    That Section 3-6 of Article III of the Charter of the City of Stillwater, Oklahoma, be amended to read as follows: 

 

Section 3-6.  Library board.

 

            There shall be a library board, which shall be the head of the library department.  It shall consist of seven (7) members appointed by the Board of Commissioners for overlapping terms of three (3) years and to serve two full consecutive terms or until their respective successors have been appointed and qualify.  The terms of members shall begin at 7:30 o’clock p.m. on the first Monday in May every year.  The Board of Commissioners may remove a member for the good of the service, and it may fill vacancies for unexpired terms.  Members shall serve without compensation.

            Every year, at the time prescribed for the beginning of the terms of new members or as soon thereafter as practicable, the library board shall elect a chairman, a vice chairman and a secretary; and the secretary need not be a member of the board.  It shall determine the time and place of its regular meetings; and the chairman or any four (4) members may call special meetings of the board.

            The library board shall have supervision and control of the public library or libraries of the city, and shall appoint the librarian or librarians and all other subordinates; provided that the board may authorize a librarian to appoint subordinates.  The library board may adopt regulations for the administration and operation of the library or libraries, subject to ordinances which the commission may enact.

 

Section 3:

 

            That in compliance with Title 11, Oklahoma Statutes, Section 13-111, said proposed Charter amendment, as above set forth, shall be filed with the City Clerk of the City of Stillwater, Oklahoma.  Said proposed Charter amendment and an announcement of the date for the charter election shall be published in a newspaper of general circulation in said City of Stillwater for at least twenty-one (21) days.  The election shall be held no less than twenty (20) days nor more than thirty (30) days after the last publication thereof.

(Proposed Charter Amendment- Article III, Section 3-6)

 

            This amendment will change the size of the Library Board from six (6) to seven (7) members and will give the Board of Commissioners the power to choose members of the Library Board.

Section 4:

 

If a majority of the registered qualified voters of the City of Stillwater voting on the questions vote in the affirmative, the proposed Charter amendment shall be properly certified and presented to the Governor of the State of Oklahoma for approval.

 

 

PASSED, APPROVED, AND ADOPTED THIS 2nd DAY OF February, 2004.
